In the future, when creating, editing, and posting AI-generated materials, it will be required to indicate that these photos and videos are made by AI. Additionally, punitive damages of up to five times the actual damage will be imposed for malicious false and manipulated information. The government announced the ‘Measures to Counter False and Exaggerated Advertising Using AI to Disrupt Market Order’ at the 7th National Policy Coordination Meeting chaired by Prime Minister Kim Min-seok on the 10th.

Recently, false and exaggerated advertisements using AI-created fake experts and celebrities’ deepfake images have been flooding the food and drug sectors. These advertisements cause consumer harm, especially to the elderly, and disrupt market order. Given the nature of digital information, these advertisements rapidly spread through SNS, necessitating swift countermeasures.

To address this, the government will quickly block the creation and spread of AI false and exaggerated advertisements and sternly punish violators to normalize market order. The Broadcasting Media Communications Commission will introduce AI-generated material labeling to help consumers recognize that the material is not real, and platforms have to manage compliance with labeling obligations by direct information providers.

Furthermore, the government will swiftly cut off the distribution of AI false and exaggerated advertisements by adding frequent advertising areas like food, cosmetics, and medical devices to written review targets, expecting quick reviews within 24 hours. Measures including urgent rectification requests to platforms by BMCC have been introduced for rapid counteraction even before final reviews.
